DMCA Copyright Policy

FilesFlix respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have established the following process to address claims of copyright infringement.

FilesFlix operates as an online service provider as defined in Title 17, United States Code, Section 512. We provide a platform for digital aesthetics and wallpapers, and we respond to valid, documented notices of alleged infringement.

1. Reporting Copyright Infringement

If you are a copyright owner, or an agent thereof, and believe that any content hosted on FilesFlix infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:

  • A Physical or Electronic Signature: The signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the Copyrighted Work: A detailed description of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works.
  • Identification of the Infringing Material: Specific identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. Please provide the specific URL(s) of the content in question.
  • Contact Information: Information reasonably sufficient to permit FilesFlix to contact you, such as an address, telephone number, and, if available, an email address.
  • Statement of Good Faith: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Our Response Protocol

Upon receipt of a valid DMCA notice containing all the information listed above, FilesFlix will:

  1. Expeditiously Remove or Disable Access: We will act quickly to remove or disable access to the material that is claimed to be infringing.
  2. Notification to the Contributor: We will take reasonable steps to notify the user who posted the content that we have removed or disabled access to that material.
  3. Record Keeping: We maintain records of all takedown requests to ensure transparency and compliance.

3. Counter-Notification Procedures

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent. To be effective, a counter-notification must be a written communication that includes the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification under Section 512(c)(1)(C) or an agent of such person.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, FilesFlix has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
